Ik vind het net als anderen hier op het forum leuk om af en toe mee te doen aan de maandelijkse foto opdracht. Om alles zo fair mogelijk te houden is het verplicht om TinyPic te gebruiken als host voor de inzendingen. Op zich vind ik dat prima, ware het niet voor het volgende gedeelte van de gebruikersvoorwaarden:
6. Proprietary Rights in Content on TinyPic.
6.1 TinyPic does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, applications, or any other materials (collectively, "Content") that you post on or through the TinyPic Services. By displaying or publishing ("posting") any Content on or through the TinyPic Services, you hereby grant to TinyPic and other users a non-exclusive, fully paid and royalty-free, worldwide, limited license to use, modify, delete from, add to, publicly perform, publicly display, reproduce and translate such Content, including without limitation distributing part or all of the Site in any media formats through any media channels. Content will be publicly available, and TinyPic and other Users may copy or display Content outside of the TinyPic Services through the quick link feature or through any other display mechanisms.
Ik heb voor het plaatsen van materiaal op fora en dergelijke bewust gekozen voor een hostingservice (ImageShack) die in zijn algemene voorwaarden de rechten voor gebruik niet vrijgeeft aan anderen:
The content that you distribute through the ImageShack Network is owned by you, and you give ImageShack permission to display and distribute said content exclusively on the ImageShack Network.
You may revoke this permission at any time by requesting your content to be removed. Such requests will be processed within a maximum period of 24 hours (but usually as short as one hour). You may request deletion and/or mark your content private through our sites' user interfaces, or by contacting ImageShack directly. After your request is processed, ImageShack will cease distribution of your content within a maximum period of 24 hours (but usually as short as one hour) and will absolve itself of any ownership of said content, implied or otherwise.
ImageShack will not sell or distribute your content to third parties or affiliates without your permission. Third parties may exercise the following options regarding your content:
Third parties may hyperlink to the page that displays your content on the ImageShack Network without modification and with proper attribution to you.
Third parties may request permission to use your content by contacting you directly.
All requests for permission regarding your content usage directed at ImageShack will be forwarded to you. All uploaded content is copyrighted to its respective owners. ImageShack directs full legal responsibility of said content to their respective owners. All content generated by ImageShack is copyrighted by ImageShack. ImageShack is not responsible for any uploaded content, nor is it in affiliation with any entities that may be represented in the uploaded content.
Ik zou het om deze reden dus op prijs stellen als de keuze voor TinyPic heroverwogen zou worden en deze in de toekomst wordt vervangen door een host die de gebruikersrechten niet vogelvrij verklaard en deze rechten bij de eigenaar van het materiaal laat liggen. Ik weet niet of het vaak voorkomt dat er door anderen gebruik gemaakt wordt van materiaal geplaatst bij die host, het gaat mij vooral om het principe, zeker gezien het feit dat er gratis alternatieven zijn die de rechten van het gemaakte materiaal gewoon bij de eigenaar laten liggen.
